Practical Experience 

Material Damage & Financial Claims - Patrick has gained experience across a wide range of industry sectors, first from a career in loss adjusting and more recently from claims consultancy assignments with Echelon.

The product liability, construction and public utility major losses Patrick has handled have involved material damage and financial aspects both in the UK and overseas. Multi-policy, including insurance towers, and multi-party scenarios have been commonplace requiring effective advocacy skills to ensure proper engagement of insurers and secure the indemnity entitlement from each insurer or party.

Claim management of high value property losses has involved the development and execution of the project plan for collation, validation and presentation of evidence and quantum, leading to the successful negotiation of a favourable outcome for the client.

Project Planning - Complex claims management requires an effective project plan, which is properly co-ordinated and executed. Patrick has worked as an integral part of the client's project team with responsibility for the development and management of the plan, including the underlying systems and processes.

Skilful Management - Interfacing with a variety of stakeholders and experts, some of whom have conflicting objectives, is a day to day experience and has required careful and skilful management in complex loss situations.

Major Loss Planning - Risk advisory services are provided to clients for major loss planning, particularly in product liability and construction, and claims defensibility advice has been provided to clients from the leisure & entertainment and manufacturing sectors.

Credentials 

Flood Claims, Water Utility Company - Acting for a UK water utility company Patrick is undertaking a claims consultancy role to prepare and present the claim to insurers following flood damage to over 200 separate asset sites and provide insurance coverage advice to the client project team.

Energy Claims, Oil Company - Following a major incident, Patrick is leading the Echelon team for the preparation and presentation of the high value claim for third party losses to the client's insurance tower.

Energy Claims, Shipping Company - Our client is a European based shipper with assets involved in oil extraction in Australasia and has a claim against the vessel hirer. Patrick is providing project management assistance to the client in relation to the development of the project plan and document management system in readiness for the dispute resolution process.

Distressed Claims, Construction Company - Insurance coverage advice under contract works and DIC/DIL policies has been given, together with re-assessment and presentation of three distressed construction claims arising from a refurbishment contract in the City for a UK top 5 contractor. Additional avenues of recovery were identified and exploited to overcome the limited indemnity available under the policies.

Product Liability Claim, Building Insulation Material Manufacturer - Evidence has been collated and expert opinion given to a major building insulation manufacturer in relation to a product liability claim where the insurer has disputed the occurrence of damage to third party property. In addition, an assessment was undertaken of the cost of projected remedial works to remove and renew the works.

Alleged Retaining Wall Failures, Construction Contractor - The array of parties involved, and the multiple insurance policies with potential exposure to claims for two alleged consecutive retaining wall failures, caused much difficulty in co-ordinating investigations and applying covers such that guidance was required by a contractor on how to manage the interfaces and uncertainty that prevailed. Clarity was provided on which policies and insurers ought to be engaged for the potential heads of claim and how best to manage the vexing issue of allocation across multiple policies.

Procedures Review, Exhibition Venue - Claims Defensibility and property damage incident response was a costly issue for a major London exhibition and event venue. A full review of existing procedures and practices was carried out by Patrick and a project completed, in conjunction with the client's management, to establish new effective protocols and embed them within the organisation.

Improve Claims Efficiency, Facilities Management Contractor - A general services and facilities management contractor possessed limited visibility of the effectiveness and efficiency of the claims handling within the self insured retentions of their insurance programme by a third party administrator. The potential financial impact was a concern and the Echelon project provided not only a case level audit of a file sample, but enhanced benefits by contributing to the development of cost savings specific KPIs, areas of delay causing unnecessary legal costs accrual and improved claims defensibility through more robust defence packs for submission to insurers.
